These Terms of Service (“Terms”) govern your use of fryd.ca (the “Site”) and any purchase you make from FRYD.CA (“we”, “us”, “our”), 1715 Government St, Victoria, British Columbia, Canada. By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. Eligibility

You must be of legal cannabis age in your province or territory of residence to use this Site or buy from us — 19 or older in most of Canada, 18 or older in Alberta, and 21 or older in Quebec. By using the Site you confirm that you meet this requirement, that you are buying for your own personal use, and that you will not resell, share with or supply products to anyone under the legal age. We may ask for proof of age at any time and may cancel orders where age can’t be verified.

2. Shipping Area

We sell to customers in Canada only. You are responsible for making sure that receiving our products is lawful where you live.

3. Products and Pricing

  • All prices are in Canadian dollars (CAD) and include or exclude taxes as shown at checkout.
  • We make every effort to describe and photograph products accurately, but packaging, colours and flavour availability may vary slightly.
  • Prices, products and promotions may change without notice. If a product is listed at an obviously incorrect price because of an error, we may cancel the order and refund any payment.
  • Product descriptions are for information only and are not medical advice. Our products are not intended to diagnose, treat, cure or prevent any disease.

4. Orders and Payment

  • Your order is an offer to buy. A contract is formed once we confirm your payment and ship your order.
  • We accept Interac e-Transfer, Skrill, cryptocurrency, and other methods arranged with our support team. Orders are held until payment is received in full.
  • Orders not paid within 48 hours may be cancelled.
  • The 10% cryptocurrency discount applies only to orders paid in full by cryptocurrency. You are responsible for sending the exact amount to the correct address and for any network fees.
  • We may refuse or cancel any order, including suspected fraud, orders that appear to be for resale, or orders we can’t verify. If we cancel a paid order, we’ll refund you.

5. Shipping, Delivery and Risk

Shipping costs, processing times and delivery estimates are described on our Shipping page. Delivery dates are estimates, not guarantees. Risk of loss passes to you when the package is delivered to the address you provided. An adult of legal age must accept delivery.

6. Returns and Refunds

Returns, exchanges and refunds are governed by our Returns Policy, which forms part of these Terms.

7. Responsible Use

Cannabis products can impair your ability to drive or operate machinery — never drive while impaired. Keep all products out of reach of children and pets. Consult a health professional before use if you are pregnant, breastfeeding, taking medication or have a medical condition. Start low and go slow.

8. Your Account

If you create an account, you’re responsible for keeping your login details confidential and for all activity under your account. Tell us right away if you believe your account has been used without permission.

9. Intellectual Property

All content on the Site — text, graphics, logos, images and design — belongs to us or our licensors and may not be copied or used without written permission. Third-party brand names and trademarks belong to their respective owners.

10. Acceptable Use

You agree not to misuse the Site, including by providing false information, attempting to access systems or data you’re not authorized to, interfering with the Site’s operation, or using automated tools to scrape content.

11. Disclaimers and Limitation of Liability

The Site is provided “as is.” To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the Site or our products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.

12. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms, your misuse of our products, or your violation of any law, including providing false age information.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Where your province’s consumer protection laws give you the right to bring a claim where you live, that right is not affected.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order.
